TERMS AND CONDITIONS OF USE

The company BORCANBAR S.L. (from now on NEWE) offers to the customers of Volt Padel the rental through its platform. All the products offered for rent can be viewed from the Volt Padel website. When the user wants to rent and “clicks” on the “rental” tab in the navigation menu of the official Volt Padel website, he/she will be on a web page that is a directory of the same managed by NEWE. These Terms of Use shall apply to all rentals and Try Before Buy that are made by users and customers.
HOW CAN I TEST A PRODUCT?
The TBB process includes the following steps:
1) From voltpadel.com website, go to the product tab and “click” on the “Try before you buy” button. The link will redirect you to https://tryit.voltpadel.com/ TBB website.
2) Add the product to your cart.
3) Enter your details.
4) Enter your credit card details (Visa, Master Card and American Express).
5) You will receive an order confirmation email once you have made the payment.
6) Before the end of the 5 days period, a payment letter will be sent to proceed with the sale of the item placed on the test model.
PURCHASING DATA
The customer assures that all data provided by him during registration or order (name, shipping address, email address, ID) are correct and that he has not used data of third parties. The customer undertakes to inform the supplier immediately of any change in the data. The customer is liable for the misuse of access data by third parties, insofar as he is responsible for this. This may also result in him being obliged to pay usage fees for products he has not ordered himself.
Terms of delivery
If the customer has rented or chosen the TBB option to the goods through the website the following delivery conditions shall apply. The product will be delivered to the shipping address provided by the customer. NEWE is entitled to make partial deliveries to a reasonable extent. If, when processing the order, the supplier discovers that the product ordered by the customer is not available despite careful examination of the stock and for reasons for which NEWE is not responsible, the customer will be informed by e-mail and the payment made will be refunded immediately if the customer so requires. The delivery times indicated in relation to the offer are approximate. Therefore, they shall only be deemed to be agreed as approximate. If the delivery time is later than the selected day of delivery of the product by the customer, the customer is entitled to request a full refund. Rental and subscription products are reconditioned and may have some superficial affections. The superficial affections will not affect in any case the proper functioning of the rented product. On the other hand, NEWE reserves the right not to send the product to the customer if there are indications that the customer may misuse the rented product.
Cancellation policy prior to the start of the rental period.
The Cancellation Policy is structured under two scenarios:
- a) Cancellation up to 8 days before the start of the rental period. In other words, if the rental is scheduled for delivery on the 10th, the customer can cancel it free of charge up to and including the 3rd and receive a full refund of the amount paid. In order to cancel the rental order, the customer service must be informed at https://tryit.voltpadel.com/contacto/.
- b) Cancellation of the rental within 7 days prior to the date of delivery of the rental product. In this case, only 50% of the amount paid by the user will be refunded. To cancel the rental order, the customer service must be informed at https://tryit.voltpadel.com/contacto/.
Return (Cancellation during the first 24 hours after receipt of the rented product)
The customer will have 24 hours to notify the customer service https://tryit.voltpadel.com/contacto/ to request the cancellation of the product. The following situations are contemplated as possible:
- The product does not work as it should. In this case, the customer should contact the Support Center to:
1) Indicate the order number, his full name and contact details (e.g. cell phone).
2) Send a photo or video of the product
3) Indicate the reasons why it is not working
4) Indicate the address where you would like the product to be picked up.
We will contact the customer to pick up the product at the indicated address and send it to our warehouse. There, a quality check of the returned product will be carried out and, if it is confirmed that the product does not work, 100% of the amount paid will be refunded within a period of 5 days from the date of cancellation.
- The product is not the one the customer had requested. (idem)
- The customer decides to cancel the order without a justified reason. In this case, you must inform the Support Center as in the previous case. The customer, as long as the cancellation email was sent within 24 hours after the customer received the product, will receive a 50% refund of the amount paid.
Cancellation after 24 hours from the receipt of the rented product.
The customer must keep the product until the end of the selected rental period and will not be refunded any amount.
Return of the product by the customer at the end of the rental period or TBB.
The logistics partner will pick up the package at the address indicated by the user during the selected day at the end of the rental period or TBB (it can also be returned to an office of the logistics partner). To do so, the customer must:
- Have the product properly packaged. For this purpose, the customer must keep the box in which the product is shipped.
- Affix the label (which includes the return data and a bar code) that was inside the package when the customer received it. Once the box is properly closed, the customer should stick the new label over the old label on the outside of the box so that the delivery person can easily remove it.
- If the customer does not deliver the product on the day indicated, a second collection will be made the following day. If the customer is unable to deliver the product even on the second attempt, he/she should contact the Support Center and request a pick-up. In this case, the customer agrees to pay the operational costs of the reverse logistics.
Conditions for customers
During the rental period or TBB the customer may not transfer the use of the goods to a third party without the prior consent of NEWE and Volt Padel, in particular the goods may not be sold, given away, rented or lent.
The customer is obliged to keep the goods free of third party rights for the duration of the rental. Furthermore, he may not modify the goods. Modification means any alteration to the goods that changes the current condition in which they were received.
If the customer returns the goods to NEWE without the accessories provided with the goods or if the goods are incomplete, the customer is obliged to return the accessories or components within 5 days. If the customer does not return the missing accessories or components within the specified period, NEWE reserves the right to demand the value of the rented product, calculated on the basis of the current market value.
Special conditions for urban mobility products
In the use and operation of urban mobility products, attention must be paid to the legal requirements and laws applicable to their use and operation on the road and road safety laws, as well as the manufacturer’s instructions for use. The customer must be of legal age; have minimum experience or skills in driving urban mobility products; be familiar with the operation and safe handling of urban mobility products and have minimum knowledge of driving and local traffic regulations.
You must also ensure that you drive and use the urban mobility product exclusively where permitted and, in addition, use and operate the urban mobility products in accordance with traffic regulations; The urban mobility product is electronically operated and intended for adults. It is not permitted to be driven by more than one person at a time.
The customer is solely responsible for the proper use of the product and shall use a helmet and/or other approved protective and safety equipment or other accessories. The use of a helmet and/or other protective equipment does not exclude the risk of injury in the event of an accident. Furthermore, the customer is liable for any damage caused to other persons during the use of the urban mobility product. The customer may not carry any object that prevents him/her from riding the urban mobility product in full condition.
Payments
Payment is processed through NEWE’s payment gateway.
Insurance
The product is insured by NEWE. The product will be covered in case of breakage, damage and oxidation, as well as in case of misappropriation by the user.
Any other circumstances not mentioned above are excluded from the coverage.
Fraud
In case of misappropriation of the product, NEWE will take legal action. This will entail reporting to the public body, and registration in default platforms (ASNEF).
